Arbitration
We support our valued partners on the various disputes that may result from their activity. The team often acts as co-counsel on international arbitral disputes providing expertise from an Egyptian law perspective. We advise and assist on resolving disputes in the construction, oil & gas, distribution and commercial fields, through arbitration under the auspices of the ICC, ICSID and CRCICA. Some of our arbitration experience includes:
PGS: on a dispute before CRCICA against a major multinational petroleum company, successfully obtaining a favourable settlement.
An Egyptian distributor of stationery goods: acted as co-counsel in an adhoc arbitral dispute against a major multinational stationary company resulting in a successful award.
A North African country: acted as legal experts before European courts in the enforcement procedures related to an award issued in favour of a foreign investor.
Competition
We advise on competition and market control matters in accordance with the Egyptian Competition Law. We also advise on organising distribution networks and drafting distribution agreements. We are well-versed in guiding clients through Egyptian Competition Authority investigations, as well as post-closing merger filings. Some of our Competition experience includes:
Global Network of Sport Channels: acted as co-counsel on an anti-monopoly dispute before the Court of Cassation.
A European manufacturing company: on providing an assessment of competition law compliance in factories and distribution.
Leading Steel Manufacturer: on an anti-dumping proceeding initiated by the Arab Republic of Egypt against imports of steel billets, rebars and wire rods from all origins, including Ukraine.
Bowmans Law Firm: completed multiple post-closing notifications to the Egyptian Competition Authority on behalf of Bowmans Law Firm clients.
Corporate, Commercial and M&A
We advise and assist national and international clients on general corporate matters, as well as domestic and cross-border mergers and acquisitions. Employment
We help our clients navigate the employment law framework in Egypt. We frequently advise foreign groups with subsidiaries in the country on the negotiation and drafting of their employment contracts, obtaining work and residency permits, recruitment formalities with the local authorities for social security, redundancy, the tax and welfare status of expatriate managers as well as the formalities for their postings. Intellectual Property
We regularly support our local and international clients in the negotiation of commercial agreements totally or partially pertaining to their intellectual property. We additionally provide legal assistance on matters including licensing and copyrights, trademark protection, and privacy and data protection, as well as in any related disputes. Pébéo: successfully obtained a favourable judgment for the client after a complex 10-year trademark dispute.
El Obour for Manufacturing: representation of client before the commercial court resulting in the successful registration of its trademark.
Alwan: registration of the trademark following the issuance of the new trademark registration law.
Litigation
We routinely advise clients across varying sectors including pharmaceutical, hospitality, consumer goods & retail, construction, transportation and real estate on employment disputes, private law disputes, public law disputes, as well as criminal law and others. An Egyptian pharmaceutical company: successful representation in a rupture of contract dispute against a major global pharmaceutical corporation.
Accor Hotel: successfully dismissed an EGP 12 million claim regarding a termination of managment and service contract and also successfully reduced an EGP 70 million claim to EGP 15 million.
A leading oil & gas company: advised on the potential risks following a major incident in one of the company’s stocks inside Cairo as well as the best action plan.
Projects & Finance
Our team advises and assists organisations across the public and private sectors on public-private partnership projects, concessions and project financing in the energy, healthcare, real estate and infrastructure sectors. Some of our Projects & Finance experience includes:
European Train Line Operator: advising and assisting on its participation to a consortium in a public tender issued by the Arab Republic of Egypt for the engineering, procurement, construction and operation and maintenance of a new train line.
Maidis: advising and negotiating the JV with the Egyptian public sector on a Public-Private Partnership contract in the healthcare sector.
